Fraud eBay seller- want refund but the seller won't respond to messages! Help!?

Last night I purchased the iPhone 3GS at a low price of �215, from a seller with a risky feedback of 3. They had a 'story' behind their sale and I found this believable, much to my mistake!:( did a bit of research on the seller and found the following day that they had relisted MY iPhone using the same picture and description, I also found that the blackberry he sold around the same time last night had also been relisted and that people are bidding on these items now, http://myworld.ebay.co.uk/cpetta1/?_trksid=p4340.l2559 (URL of seller's page) tried to contact seller but the phone number on his paypal is a fake 10 digit number- really dont know how to get a refund and want to try and get rid of this seller once and for all- it's a shame for the people who are currently bidding on the two phones just now though:( hope someone can help me :( xxx
